Welcome to 19pine, provided by 19pine Private Limited ("we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of our website, mobile applications, and services (collectively, "Service"). 19pine utilizes advanced language processing technologies to facilitate communication with businesses on behalf of our users for various purposes, including but not limited to, resolving billing issues, updating account information, and cancelling services. Users instruct our platform to perform tasks by providing necessary personal and sensitive information.

3. User Account

  • Account Creation: To use the Service, you must create an account providing accurate and complete information. You are responsible for maintaining the confidentiality of your account and password.
  • Account Responsibilities: You are solely responsible for all activities that occur under your account. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Authorization for Phone Number Usage

By agreeing to these terms, you authorize 19Pine to use your provided phone number for the purpose of making calls to businesses on your behalf. This authorization allows 19Pine to display your phone number as the caller ID when contacting businesses, ensuring that the recipient recognizes the call as coming from you. Your phone number will be used solely for this purpose, providing a seamless and personalized interaction with the businesses you wish to contact through our service. You can revoke this authorization at any time by updating your preferences in your account settings.

5. Service Guarantees

If we determine that your purchase wasn’t shipped according to the merchant’s promised timeframe or method, we might reach out to the merchant on your behalf to seek a refund or another form of compensation. To qualify for any benefits, your purchase must adhere to the merchant’s policy guidelines. This service may not always be available, but if we extend it to you, it will be offered at no cost unless we inform you otherwise. By accepting our assistance, you agree to accept any resolution we secure as final.

6. Merchants

19Pine is independent of the Merchants from whom we seek refunds and other benefits. Merchant policies vary significantly, and some may only offer refunds on specific items. 19Pine neither owns nor controls the customer satisfaction policies of these Merchants, and such policies may change without notice. For your convenience, we provide a summary of each Merchant’s policy in the Merchant section of our website, which we will periodically update as we become aware of changes. However, for the most up-to-date information, please refer directly to the Merchant’s website. 19Pine is not responsible for the actions, interpretations, or policy applications of Merchants, nor for their refusal to issue a refund or other resolution you believe is owed. Additionally, 19Pine reserves the right to modify its list of eligible Merchants at any time.

7. User Conduct You agree not to use the Service to:

  • Engage in any unlawful, fraudulent, or deceptive activities.
  • Interfere with or disrupt the Service or servers or networks connected to the Service.
  • Violate any applicable local, state, national, or international laws or regulations.

When you create an account for the Service (“19Pine Account”), you agree not to use a username or email address that belongs to someone else, impersonates another person, infringes on intellectual property rights, or is deemed offensive at 19Pine’s discretion. You also agree to provide accurate, up-to-date, and complete registration information about yourself and to update this information promptly if it changes or upon our request. You confirm that any Linked Account you connect belongs to you and that you have the right to link to it. You are responsible for maintaining the security of your 19Pine Account and for all activities that occur under both your 19Pine Account and Linked Account, whether or not you authorized them. You must notify us immediately of any unauthorized use of your 19Pine Account or any other security breach. You may not sell, transfer, or assign your 19Pine Account to another person without our explicit written consent. You affirm that any dispute or request you submit is based on a legitimate issue you are experiencing. You are responsible for any damages caused to 19Pine or others due to disputes involving false or misleading information or from reselling our services. You must have a genuine belief in the accuracy of any information or personal details you provide to 19Pine. You are prohibited from using any part of our website or intellectual property if you have been notified that you are not permitted to do so (“Ban Notification”). A Ban Notification may be issued through an automated 19Pine system, via email to the address on file (from support@19Pine.ai), or through a message from a 19Pine employee.

8. Content

  • Ownership: You retain all rights in, and are solely responsible for, the content you create or own.
  • Permissions: By using the Service, you grant us a worldwide, royalty-free license to use, reproduce, distribute, and display the content only in connection with the Service.

9. Fees and Payment

Subscription

  • Fees and Billing: Subscription to certain features of our Service requires payment of fees. By subscribing, you agree to pay the subscription fees at the current rate as disclosed at the time of your subscription. All fees are billed in advance and are non-refundable, except as expressly provided in these terms.
  • Auto-Renewal: Your subscription will automatically renew at the end of each billing cycle unless you cancel it at least 24 hours before the end of the current period. You can manage and cancel your subscriptions by going to your account settings on the 19pine website or app.
  • Changes to Subscription Fees: We reserve the right to change our subscription fees upon reasonable advance notice. We will notify you of any fee changes by email or through a notification in the Service.

Refund Policy

  • General: Payments made to 19pine are generally non-refundable. However, if you believe that 19pine has charged you in error, you must contact us within 30 days of such charge. No refunds will be given for any charges more than 30 days old.
  • Service Issues: We strive to provide the highest quality service but cannot guarantee that our service will be free from defects. If you are dissatisfied with the service, please contact us. At our discretion, we may offer a refund, discount, or other consideration.
  • Subscription Cancellations: If you cancel your subscription, you will have access to your subscription until the end of the current billing cycle; no refunds will be provided for any remaining days in your subscription period.

Free Trials

  • Eligibility: Free trials are offered at our discretion and are subject to eligibility checks. We reserve the right to withdraw or to modify a free trial at any time without prior notice and with no liability.
  • Trial Period: If you enter into a free trial, you will not be charged during the trial period. At the end of the trial period, unless you cancel, your subscription will automatically continue and you will be billed the applicable subscription fees.
  • Cancellation of Free Trial: You may cancel your free trial at any time before the trial period expires. If you do not cancel, you authorize us to charge your payment method for the subscription fee as stated at the time you agreed to begin the trial.

11. Termination

You may terminate your 19pine Account at any time by emailing support@19pine.ai from the email that you used to initially sign up.

12. How do we work?

Our Service operates automatically by monitoring customer policies and relevant laws on popular online platforms. When we identify potential savings or refund opportunities based on your purchase history, we will interact with Merchants on your behalf, using your details to secure the benefit. This process may involve the automatic cancellation and repurchasing of a ticket or service. By using our Service, you authorize 19Pine to act as your agent in carrying out these actions. When you register for the Service, you may need to link your personal email account, such as Google (“Linked Accounts”), bank account an or credit card account to the Service. To identify savings opportunities for you, we will review the contents of your Linked Accounts, including receipts, correspondence, and contact information.

13. Limitation of Liability

19pine private limited, its directors, employees, partners, agents, suppliers, or affiliates, shall not be liable for(A) any loss or damage, indirect, incidental, special, consequential or punitive damages, including without limitation, economic loss, loss or damage to electronic media or data, goodwill, or other intangible losses, or (B) for any amount in the aggregate in excess of the fees actually paid by you in the six (6) months preceding the event giving rise to your claim, resulting from (i) your access to or use of the Service; (ii) your inability to access or use the Service; (iii) any conduct or content of any third-party on or related to the Service; (iv) any content obtained from or through the Service; and (v) the unauthorized access to, use of or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other claim in law, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Any purportedly applicable warranties, terms and conditions are excluded, to the fullest extent permitted by law. Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance. 19pine private limited, its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements. If you breach any of these Terms and 19pine private limited chooses not to immediately act, or chooses not to act at all, 19pine private limited will still be entitled to all rights and remedies at any later date, or in any other situation, where you breach these Terms. 19pine private limited does not waive any of its rights. 19pine private limited shall not be responsible for any purported breach of these Terms caused by circumstances beyond its control. A person who is not a party to these Terms shall have no rights of enforcement. You may not assign, sub-license or otherwise transfer any of your rights under these Terms.

16. Governing Law

These Terms shall be governed and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions.
